The website SAPOPA.COM and all of its contents are managed and maintained by the SAPOPA SRL company located in Viale Trento 23,36100 Vicenza, Taxpayer n° and VAT n°03527160240. N° R.E.A. (Economic Administrative Index) VI 332415, fully paid-up capital Euro 1.510.000,00 Access to the site and use of the SAPOPA.COM, website as well as the offer and sale of products through the SAPOPA.COM website are regulated by the present General Conditions of Sale.
Access and use of this website as well as the purchase of products on SAPOPA.COM presuppose reading, knowing and accepting the General Conditions of Sale.
By accessing the SAPOPA.COM website, customers agree to accept and comply with all the terms and conditions in the website.
The SAPOPA.COM website gives the customer a virtual showcase of products (sport gear and accessories) which can be purchased online under the methods and terms described below.
The SAPOPA.COM website allows the user to select specific characteristics (size, dimensions, colour, etc.) of the chosen product and proceed to purchasing by clicking on "CONFIRM AND PAY" ("point and click").
This way, the user agrees to purchase the selected product with the selected features and, consequently, to pay its price.
Placing an order is binding, unless one is exercising their right of withdrawal, under the conditions described below.
By placing an order, the customer unconditionally accepts the present General Conditions of Sale and agrees to observe them in accordance with the terms.
SAPOPA SRL will then undertake to ship the purchased item to the address indicated at the time of purchase.
3) Order confirmation
SAPOPA SRL will confirm your order within 48 hours of its receipt, once availability of the actual product in stock has been verified.
The order confirmation will report the description of the purchased products, their price and other information regarding the order and the pre-contractual information as in Article 1 of the present General Conditions of Sale.
In the event that the product is out of stock or otherwise unavailable SAPOPA SRL will promptly notify you – at the email address provided during registration – and will proceed to the cancellation of the order without any charge on your behalf.
4) Intellectual property rights
SAPOPA.COM and any related graphic content from the website are the exclusive property of SAPOPA.SRL
That includes, therefore, documents, images, photographs, texts, design, music, software, codes and format scripts. Any reproduction, modification, transmission, publication or redistribution to third parties, for commercial purposes, is prohibited by the Industrial Property Code, by the Copyright Law and by provisions of the Civil Code currently in force and cannot occur without prior written consent granted by SAPOPA SRL.
5) Commercial policy
SAPOPA SRL has created and published the website SAPOPA.COM in order to offer an exclusive service reserved for its clients.
The items for sale on SAPOPA.SRL website are intended only for consumers, not distributors, retailers, sales representatives, etc. In accordance with the provisions of Legislative Decree 06.09.2005 n°206, consumer, customer and user refer to the natural person who uses the services offered on the
SAPOPA.SRL website for purposes other than the profession in trade, business or craft they may practise.
Therefore, SAPOPA SRL invites the users who do not belong to the abovementioned category to refrain from attempting to establish business relationships with SAPOPA SRL and/or from placing orders to purchase goods for sale, even through third parties.
In view of the commercial policy described above, SAPOPA SRL reserves the right not to process orders for goods sent by individuals who prove not be consumers.
6) Mistakes or inaccuracies, disruptions, website update
SAPOPA SRL publishes information on its website in order to provide its customers with a constantly updated service and takes every precaution to ensure its users that the SAPOPA SRL. contents are accurate and do not contain imprecisions or out-of-date information on the date of publication; SAPOPA SRL disclaims any responsibility regarding the possibility of any technical or content inaccuracies and/or typographical errors and/or disservices, also related to the internet connection or the deactivation of cookies, which depend on factors external to SAPOPA SRL, ensuring in any case the timely restoration of the website and/or its content.
SAPOPA SRL also declines any responsibility regarding the possibility that, due to a particular configuration of the computer used by the customer or due to its malfunctioning, the colours of the products displayed on the website show a difference in colour compared to the original ones, or that the texture of the fabrics and/or materials the items are made of appear different from the original ones.
SAPOPA SRL, also in order to provide accurate and updated information, reserves the right to make corrections and alterations on the website when deemed necessary.
Similarly, SAPOPA SRL reserves the right to modify the present General Conditions of Sale if the need arises.
Any modifications to the General Conditions of Sale will first be reported on the homepage of the and will be automatically applied to new orders.
SAPOPA SRL adopts technical and organizational measures to safeguard the security of its services on the SAPOPA.COM website and to enable the customer to identify and correct any input errors prior to the order.
The website SAPOPA.COM observes international standards to ensure the security of its e-commerce transactions.
7) Legal Compliance Warranty
In the event the received product presents any lack of conformity, the user may exercise the rights provided by Articles 128 et seq. of Legislative Decree 206/2005. Should a lack of conformity be confirmed, the customer, at their option, has the right to have the product restored free of charge through repair or replacement of the faulty product by SAPOPA SRL, unless the solution requested is impossible or excessively costly compared to the other.
If neither replacement nor repair are possible or are prohibitively expensive, or if SAPOPA SRL has failed to repair or replace the goods within a reasonable amount of time, or if the replacement or repair carried out has caused significant inconvenience to the user, the latter is entitled to a discount or refund, the sum of which will be commensurate with the value of the good. In the latter case, the defective product will be returned to SAPOPA SRL.
The user loses their guarantee if they do not notify the problem within 15 days of the date of its discovery.

In any case, SAPOPA SRL disclaims any liability related to business practices or contract terms dictated unilaterally by the economic operators chosen by the user for the payment of the product bought on the SAPOPA.COM website.
The user will be informed of the shipment via e-mail. The message will report the products shipped and the package reference number to enable constant tracking.
The cost for each shipment is calculated based on the country your order has to be shipped to. During the checkout process the shipping costs will be automatically added to your order total.

Orders are shipped from Italy on working days (Monday – Friday from 9:00 a.m.– 6:00 p.m. CET). Orders placed Friday evening, Saturday, and Sunday will be processed on Monday.
For shipping outside EU, the final checkout price is exempt from VAT (Value Added Tax) and include shipping and import fees.
Eventual additional local taxes not related to custom import, such as State Tax or Use Tax, are not included and are the customer's responsibility.
10) Right of withdrawal
The purchased product can always be returned within 15 working days of the day it was physically received and without any obligation to provide reasons, in accordance with what follows.
The user should provide order number and item number to help SAPOPA SRL identify the commercial transaction.
The package must contain the item(s) you intend to return as well as what may be required according to the following paragraph.
In any case the return of an item must be completed within 15 days of notifying the intention to exercise the right of withdrawal.
The shipping costs, unless there are special promotions, will be incurred by the customer.

As long as the return occurs according to the terms described above, once the package has been received and the points in the following Article have been checked,
SAPOPA SRL will transfer the sum corresponding to the purchase price of the product, net of shipping costs.
11) Inappropriate handling of returned items
The products being returned need to have been worn/viewed exclusively for the time necessary to check the size, the fit and/or the appeal of the product.
Any other use is forbidden.
The products must also be in their original condition, in order to be able to be put up for sale again. They must not show any signs of usages other than trying the product on. They must not be damaged or soiled. In particular, they must be returned with all the tags, original packaging accessories (dustbags, hangers, covers, etc.) received together with the item.
All the bags and accessories must be shipped together with their package and/or original box, which form part of the goods and must not be damaged and/or modified in any way. The perfumes and toiletries must be returned with wrapper and information notices perfectly intact without having been opened.
All returns will be carefully examined by SAPOPA SRL; the user is liable for any diminished value of the goods resulting from handling the product other than that needed to establish the nature, the characteristics and the functioning of the product; any decrease in the value of the product will be withheld from the amount of the refund.
12) Faulty items
In the event that the product presents defects, SAPOPA SRL reserves the right to request photographic evidence before allowing the return.
In this case, if the existence of the defect is confirmed, SAPOPA SRL will bear all shipping costs for returning the product and will see to the dispatch of a new product, provided it is still available, or to its repair if possible, or, finally, to the refund of the entire amount paid by the customer for the purchase of the product, including any shipping costs paid by the customer.
The customer agrees to abide by the same notification methods as those described above regarding the right of withdrawal.

13) Shipping fees
The shipping and returns costs can exceptionally be paid by SAPOPA SRL in the event the latter has undertaken occasional promotional campaigns – communicated with special banners on the website – for reducing or cancelling additional costs for customers.
In that case, the provisions of the present terms and conditions regarding the assumption of shipping or return costs can be disregarded.
In any case, the shipping costs for mistakes attributable to SAPOPA SRL will not be at the customer's expense.
14) Applicable law, jurisdiction and conciliation body
The present General Conditions of Sale are subject to Italian law and – in the event of disputes over its interpretation, application and validity – to the jurisdiction of the courts of the place of residence or domicile of the customer if they are an Italian resident.
Any other case falls under the jurisdiction of the Court of Vicenza, except for the enforcement of the law and of competent courts established by international treaties and by regulations in force when the dispute arises.
